ADOS and Caste discrimination

Progress is being made on SB 403, a California bill to prohibit caste discrimination, despite the protests and opposition of upper-caste people of South Asian descent. However, I’d argue that African Americans who are descendants of U.S. enslaved people should find a stake in this legislation.

There is an argument to be made for African Americans who are descendants of antebellum slaves to claim a stance against caste discrimination. The slave status had a unique impact upon the immediate generations of those enslaved as well as their descendants, even to the present. Those who are descended from antebellum slaves cannot claim descent from willful immigrants who switched their prior nationalities to embrace that of the U.S. citizen. They also cannot claim to be indigenous, aboriginal or autochthonous in their historical ties to the land claimed by the United States. Instead, their ties to this nation are rooted exclusively in the enslavement of their ancestors on this land. 

Race, including biases and prejudices along such lines, cannot and does not explain this status and its implications upon this community. The ADOS movement correctly claims that “lineage” from the enslaved entitles this community to specific legal consideration distinct from more recent immigrants of African, Afro-Caribbean or Afro-South American origin. 

But the word lineage, arguably, does not exactly entail the historic socio-economic, political, environmental, ethical and institutional treatment of those who are of said lineage. Isabel Wilkerson’s thesis of the distinct position of the American descendant of slaves within an hierarchy of submission and exclusion as a “caste” position goes further to encompass this status position. 

It is therefore of interest to those who seek continued structural transformation to eliminate and undermine this system, to allow for more race-neutral avenues to enable total socio-economic mobility for African-Americans, to embrace the legal prohibition of discrimination against perceived lower castes of society in the United States. 

It would be in the interests of advocates for racial justice to also tackle discrimination on the basis of caste against the descendants of freedmen. By treating descendants of freedmen as a socio-economic caste parallel to an ethnic group, legal discussion of race can become divorced somewhat from the specific conditions visited upon these descendants as opposed to others who faced lesser acts of institutional discrimination. 

Thoughts on Threads:

  • From what I’ve read, there’s not much to it yet.
  • If you have a Mastodon account, you don’t need to sign up for Threads. You will be able to directly interact with Threads posts and users soon enough.
  • when they flip the switch on joining the Fediverse, it can become an “Eternal September” type of situation for other Fediverse servers, like when AOL joined millions of people to the Usenet network in 1993.
  • Meta will have to learn how to segregate their advertising and data retention interests away from other Fediverse servers. Numerous Fediverse servers have preemptively defederated from Threads in advance out of fears over these interests.
  • Meta will also have to learn how to play nice with other Fediverse servers when it comes to data migration between servers. Otherwise they can find themselves locked out through defederation.
  • If you wanted the idea of “microblogging social media as a public, distributed utility like email” to go mainstream, something like Threads may be the first well-funded foray into that idea. No turning back now.
  • If you wanted to no longer have to be locked out from your friends and content because the social media app du jour doesn’t work well anymore/doesn’t play nice with other apps, watch this space.

On the Last Few God-Awful SCOTUS Opinions

The Conservative Litigation Industry

Remember:

  • SCOTUS under Roberts frontloads cases to curry good press first before giving their Republican base, especially the conservative litigation lobby, the red meat they want at the end of the term;
  • SCOTUS under Roberts only rejected the worst interpretation of the independent state legislature theory in #MoorevHarper and allowed for future litigation on the theory;
  • SCOTUS under Roberts only ruled against Alabama in #AllenVMilligan because Alabama did not present (read: lie) well enough in favor of their current congressional map, but SCOTUS still allowed for future litigation to potentially gut Section 2 (see Kavanaugh’s concurrence).
  • SCOTUS ruled that affirmative action may be justified if one writes an essay about individual impacts of race discrimination in one’s life, and that will likely warrant further litigation. A boon for the conservative litigation lobby;
  • SCOTUS in #303Creative carved a religious exception to nondiscrimination laws that will also invite further litigation. Another boon for the conservative litigation lobby.

On 303Creative

The wrong question in response to the 303creative case is “can I deny service to right-wing Christians/Jews/Muslims”

The right question is “where in this country are dissenting people vulnerable to monopolies or dominance by businesses who support this decision and how can I help”

Catholic and Christian hospital, adoption, shelter and related systems who dominate whole regions of states should be delighted by this decision. They have a opening to drive a truck through nondiscrimination laws, with few federal options since we did not pass the Equality Act last year.

On Affirmative action

The ADOS movement, including its paragons such as Yvette Carnell and Sandy Darity, has demanded strict limits for reparations to descendants of antebellum slavery in the United States. In fact, it was one of the most rampant and angry demands directed by testimony to the California Reparations Task Force, which issued their final report on June 29; it was also supported by California Secretary of State Shirley Weber.

This Supreme Court ruling, which has struck down race-based affirmative action and inverted the 14th Amendment into itself, likely opens the doors for a redirection of affirmative action towards lineage-based affirmative action.

More on SCOTUS redistricting rulings

  • Alabama’s legislature will approve a new congressional map with a second VRA district by July 21. The plaintiffs’ remedial map, which goes for a least-change approach, might be adopted, but several submissions have been sent.
  • SCOTUS rejecting Louisiana’s appeal defending their congressional maps is only a partial victory for fairer maps. The case was sent back to the 5th Circuit to decide whether to continue hearing Louisiana’s appeal or to send it back to the Middle District of Louisiana which already ruled against the map. We shall see, but either Louisiana or the 5th Circuit can draw this one out.
  • The denial of cert to Ohio’s case defending their shit maps is not a victory for fair maps at all. Unless Ohio defeats Issue 1, most other attempts at redistricting reform in that state are f**ked.
  • Still nothing regarding Rose v. Raffensperger from the 11th Circuit, beyond both plaintiffs and the state sparring in dueling letters to the court asserting Milligan and Gingles‘ applicability to the case immediately following the Milligan decision.
  • I tried redrawing a map with a second majority-Black district for Louisiana’s PSC. I don’t think it worked.

King of Skrunkles [The Owl House 3D Animation]

The Owl House is concluding with its finale Watching and Dreaming soon, which has me very excited but also kinda sad, so I made this animation with King as a little tribute to this beautiful series. The show is chock-full of amazing art and visuals but I especially love King’s design, he is adorable plus he reminds me of Cubone from Pokemon, which makes him even more adorable. Honestly can’t wait for the final episode!
